Sales tax breaks for women and families in Texas

Being a woman or a parent is expensive, but finally the Texas Legislature has listened by passing Texas S.B. No. 379. Effective September 1, 2023 new sales tax exemptions are in place for necessities to help reduce the financial burden as costs continue to increase.

There is finally a sales tax exemption for diapers, wipes, maternity clothes, feminine hygiene products and baby bottles. For lactating parents there is now a sales tax exemption for milk storage bags, pumping bras, breast pumps including additional flanges and tubing.

If you live in Texas or have purchased any of these items in Texas after September 1, 2023 please make sure that you are not being charged sales tax for these items. If you have ordered any of these items online after September 1 please reach out to the company that you ordered from to make sure they are aware of these changes.

Texas S.B. No. 379

Section 151.313 Subsections (h) and (i) creates a sales tax exemption for children’s diapers and wipes.

Section 151.1312 creates a sales tax exemption for Feminine Hygiene Products.

Section 151.3133 creates a sales tax exemption for Maternity Clothing.

Section 151.3134 creates a sales tax exemption for Breast Milk Pumping Products.

Section 151.3135 creates a sales tax exemption for Baby Bottles.
